General Participant Agreement.

This Agreement applies to TGIF rides, events, and related activities in which I voluntarily participate during the twelve (12) months following my acceptance of this Agreement, unless TGIF requires me to execute a separate event-specific agreement.

For purposes of this Agreement, an “Activity” includes the applicable bicycle ride or event and related check-in, staging, regroup locations, aid or support stops, demonstrations, equipment use, social gatherings, post-ride activities, transportation arranged or provided in connection with an Activity, and other activities organized by TGIF in connection with that Activity.

An event-specific agreement may supplement or replace this Agreement for a particular Activity.

“Released Parties” means TGIF and its current and former members, managers, officers, employees, Ride Guides, volunteers, agents, representatives, contractors, affiliates, successors, assigns, insurers, event organizers, sponsors, event partners, participating retailers, bicycle shops, venues, property owners, landowners, and other persons or entities assisting with, supporting, hosting, or providing services in connection with an Activity.

Governmental entities, public agencies, land-management agencies, and other public entities are included only to the extent they may lawfully be released under applicable law.

I voluntarily choose to participate in TGIF Activities.

I understand that cycling and outdoor recreation involve significant and inherent risks and may result in serious injury, permanent disability, paralysis, property damage, or death.

I am responsible for determining whether I possess the physical condition, health, fitness, bicycle-handling ability, judgment, equipment, and experience necessary to participate safely.

TGIF does not medically screen participants and does not guarantee that an Activity or route is appropriate for my abilities.

I understand that TGIF Activities may involve known and unknown risks, including, without limitation:

• falls, crashes, collisions, and loss of control;
• collisions or interactions with motor vehicles, bicycles, riders, pedestrians, animals, wildlife, objects, or other persons;
• gravel, loose rock, sand, mud, roots, ruts, potholes, washboard, water crossings, debris, uneven pavement, technical terrain, singletrack, steep climbs and descents, exposed terrain, blind corners, and other surface conditions;
• public roads, intersections, traffic, road crossings, construction, inadequate shoulders, vehicles, and roadway hazards;
• bicycle, tire, component, safety-equipment, or other mechanical failure;
• weather, heat, cold, wind, rain, snow, lightning, wildfire, smoke, poor air quality, sun exposure, darkness, reduced visibility, and changing environmental conditions;
• altitude, fatigue, dehydration, overexertion, nutritional problems, illness, allergic reactions, physical distress, and other medical events;
• remote locations, limited or nonexistent cellular service, delayed emergency response, limited medical access, and delayed or difficult evacuation;
• inaccurate maps, route files, GPS information, signage, turn instructions, trail information, or navigation;
• route changes, road or trail closures, construction, land-use restrictions, missing turns, or becoming lost or separated from others;
• actions, mistakes, errors in judgment, or omissions by other participants, Ride Guides, volunteers, motorists, event personnel, sponsors, event partners, or other persons;
• food, beverages, aid stations, mechanical assistance, demonstrations, loaner or demo equipment, transportation, or other support offered in connection with an Activity;
• risks associated with group riding, drafting, descending, riding in close proximity to others, and riders traveling at different speeds or skill levels;
• the condition or maintenance of roads, trails, facilities, venues, or property; and
• the ordinary negligence of one or more Released Parties, to the fullest extent permitted by law.

I understand that this list is illustrative and not exhaustive.

Conditions may change before or during an Activity, and risks may exist that TGIF does not know about or could not reasonably identify in advance.

I am responsible for my own safety, conduct, equipment, and decisions.

I agree that I will:

• use a bicycle reasonably appropriate for the Activity and maintain it in safe operating condition;
• inspect my bicycle and equipment before riding;
• wear a properly fitted bicycle helmet while riding;
• obey applicable traffic laws, trail rules, closures, land-management rules, and lawful instructions;
• ride within my abilities and exercise reasonable judgment;
• carry appropriate food, water, clothing, tools, repair supplies, identification, navigation, medication, and other equipment;
• stop, walk, turn around, alter my route, or discontinue participation if I determine conditions exceed my ability or comfort level; and
• avoid participating while impaired by alcohol, drugs, medication, illness, fatigue, or another condition that makes participation unsafe.

Unless TGIF expressly states otherwise, I understand that TGIF Activities are not no-drop rides.

I may become separated from Ride Guides or other participants.

Aid stations, Ride Guides, volunteers, route information, mechanical assistance, communications, transportation, or other support are supplemental conveniences and are not guarantees of assistance, rescue, navigation, supervision, or safety.

TGIF may provide routes using Ride with GPS, Strava, GPS files, maps, websites, printed materials, third-party applications, or other sources.

I understand that route information may contain errors or become inaccurate because of changing road, trail, weather, construction, land-access, or other conditions.

I remain responsible for navigation and for determining whether conditions are safe and lawful to ride.

A Ride Guide’s presence does not constitute a representation or guarantee that a route, feature, crossing, descent, road, trail, or other condition is safe for me.

I KNOWINGLY AND VOLUNTARILY ACCEPT AND ASSUME THE RISKS OF PARTICIPATING IN TGIF ACTIVITIES, INCLUDING INHERENT RISKS, THE RISKS DESCRIBED IN THIS AGREEMENT, RISKS THAT ARE KNOWN OR UNKNOWN, AND RISKS ARISING FROM THE ORDINARY NEGLIGENCE OF A RELEASED PARTY TO THE FULLEST EXTENT PERMITTED BY LAW.

TO THE FULLEST EXTENT PERMITTED BY LAW, I RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE THE RELEASED PARTIES FOR CLAIMS, DEMANDS, DAMAGES, LOSSES, LIABILITIES, ACTIONS, OR CAUSES OF ACTION ARISING OUT OF OR RELATING TO MY PARTICIPATION IN A TGIF ACTIVITY, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF A RELEASED PARTY.

This includes, to the fullest extent permitted by law, claims involving bodily injury, illness, emotional injury, death, property damage, loss, rescue or medical expenses, and other damages arising directly or indirectly from an Activity.

This release is intended to provide the Released Parties with the broadest protection permitted by applicable law.

This Agreement does not release any claim that applicable law prohibits from being prospectively released, including, where applicable, claims based on gross negligence, reckless conduct, willful or wanton misconduct, non-waivable statutory or regulatory duties, or strict products liability.

I accept responsibility for my own actions.

To the fullest extent permitted by law, I agree to indemnify and hold harmless the Released Parties from third-party claims, liabilities, damages, losses, or reasonable costs arising from:

• my negligent, reckless, unlawful, or intentional conduct;
• my violation of applicable law or trail rules;
• my material breach of this Agreement; or
• injury or property damage that I cause to another person.

This provision does not require me to indemnify a Released Party for liability that applicable law prohibits that Released Party from transferring to me.

If I become injured or ill and am unable to make decisions for myself, I authorize TGIF personnel, Ride Guides, volunteers, emergency responders, or others assisting with an Activity to seek or provide reasonable emergency assistance on my behalf.

TGIF does not undertake or guarantee medical treatment, rescue, evacuation, transportation, or emergency response.

I am responsible for medical, rescue, evacuation, ambulance, transportation, or similar expenses incurred on my behalf except to the extent another person is legally responsible.

I am responsible for my bicycle, equipment, vehicle, clothing, electronics, and other personal property.

TGIF does not undertake responsibility for lost, stolen, damaged, or unattended property.

I understand that TGIF does not provide personal medical, health, accident, bicycle, property, or travel insurance for me unless expressly stated in writing.

Some TGIF Activities may include social gatherings where alcoholic beverages are available.

If I consume alcohol, I am solely responsible for determining whether I am legally permitted to drink and for my consumption, transportation, and conduct.

I will not ride, drive, or operate equipment while impaired.

Nothing in this section eliminates any duty that applicable law makes non-waivable.

I understand that TGIF Activities may be photographed, filmed, recorded, or otherwise documented.

I grant TGIF permission to photograph, film, record, and otherwise capture my image, likeness, voice, appearance, and participation.

I grant TGIF a worldwide, perpetual, royalty-free right to reproduce, edit, publish, display, distribute, archive, and use that material in TGIF editorial, documentary, website, social-media, event, advertising, promotional, community, and marketing communications.

TGIF may also permit sponsors or event partners to use TGIF-authorized event imagery depicting me for sponsorship, event-recap, editorial, community, advertising, or promotional purposes.

I understand that I will not receive compensation for such uses.

Nothing in this provision authorizes TGIF or another party to falsely state that I personally endorsed a product or provided a testimonial that I did not provide.

TGIF may collect my first name, last name, email address, Activities for which I register, and other information reasonably necessary to administer TGIF Activities and this Agreement.

I authorize TGIF to use my name and email address for communications concerning:

• Activities for which I register;
• route and schedule information;
• safety information;
• weather or event changes;
• upcoming TGIF rides and events;
• TGIF community news and programs;
• merchandise;
• partnerships; and
• TGIF promotions and marketing.

I understand that promotional emails will provide a means to unsubscribe from future promotional communications.

This General Agreement does not authorize TGIF to provide my email address to an event sponsor for that sponsor’s independent marketing. Sponsor marketing disclosures require an applicable TGIF Signature Event Agreement or other express event-specific authorization.

TGIF’s collection, use, disclosure, retention, and protection of personal information is described further in the TGIF Privacy Policy, available through the TGIF website.

I acknowledge that the Privacy Policy was made reasonably available to me in connection with this Agreement.

Nothing in this Agreement requires me to waive a privacy right that applicable law makes non-waivable.

I represent that I am at least eighteen (18) years old and legally competent to enter into this Agreement.

A person under eighteen may participate only if permitted by TGIF and after completion of TGIF’s then-current parent or legal guardian agreement and any additional documentation required by law.

For an Activity occurring principally in California, this Agreement will be governed by California law, without regard to conflict-of-law principles. Subject to any mandatory law governing venue, any dispute arising from the Activity or this Agreement will be brought in a court of competent jurisdiction in the California county in which the Activity begins.

For an Activity occurring principally in Colorado, this Agreement will be governed by Colorado law, without regard to conflict-of-law principles. Subject to any mandatory law governing venue, any dispute arising from the Activity or this Agreement will be brought in a court of competent jurisdiction in Boulder County, Colorado.

For an Activity occurring principally in any other state, this Agreement will be governed by the laws of the state in which the Activity principally occurs, without regard to conflict-of-law principles. Subject to any mandatory law governing venue, any dispute arising from that Activity or this Agreement will be brought in a court of competent jurisdiction in the county or equivalent jurisdiction in which the Activity begins.

If any provision of this Agreement is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed to the minimum extent necessary.

The remaining provisions will remain in full force and effect.

Nothing in this Agreement is intended to waive or eliminate liability that applicable law prohibits the parties from waiving or eliminating.

This Agreement contains the agreement between TGIF and me regarding the subjects addressed here, except for an event-specific agreement that expressly supplements or replaces it.

No Ride Guide, volunteer, sponsor representative, or other person may orally modify this Agreement.

I agree that this Agreement may be accepted electronically.

My handwritten signature, electronic signature, selection of “I Accept,” “Agree,” or substantially similar affirmative action constitutes my signature and acceptance of the entire Agreement.

Separate initials, checkboxes, or signatures are not required for any individual provision unless TGIF expressly requires them on a particular platform.
